Any dispute, controversy, or claim arising out of or relating to your use of the NJD Web technological platform, its open digital library, or its technical consulting and remote IT support services, which cannot be amicably settled through direct good-faith negotiations within thirty (30) days, may be submitted to impartial mediation. This mediation must be agreed upon by both parties and conducted in accordance with recognized structural resolution processes in effect within the applicable jurisdiction.
In the absence of a successful resolution through mediation protocols, any remaining dispute will be submitted to binding arbitration in accordance with standard arbitration principles. The arbitration will be handled by a neutral and mutually trusted arbitrator who will review the technical parameters, system access configurations, or transaction receipts impartially. Each party will share the structural arbitration costs equally, while maintaining individual responsibility for their independent legal representation.
If neither mediation nor arbitration succeeds in resolving the dispute, both parties explicitly agree to submit the matter to the exclusive jurisdiction of the competent courts of Brazzaville, Republic of the Congo, where our foundational corporate infrastructure is registered. These Terms of Use shall be governed by, construed, and enforced in accordance with the laws of the Republic of the Congo, without regard to conflict of law principles.
